In reading, viewing/signing this agreement you agree that as a renter/driver, independent contractor you are not an agent or employee of TAKEOFF, in any way. You agree to adhere to all terms and operate all TAKEOFF vehicles under this restricted "Permissive use” agreement for the full terms of use with annual renewal each year after if not cancelled within (14) days of renewal. You agree to "be on time" to Pick-Up/Drop-Off all clients including TAKEOFF Staff/affiliates without pay any time upon request. You agree not to use vehicles for “personal use” as you understand & agree that you will not be legally covered/insured for the use thereof and it is illegal to operate outside of rental business hours and you will be held fully liable for any occurrences as you agree to drive at your own risk. You agree to complete a (1) hour operator training course in person, online or video review with TAKEOFF Inc. at any time upon request. You further agree not to lend, sublease, drop-off, leave keys/card, transfer vehicle/driver possession to any other uninsured, unauthorized individual without TAKEOFF express written stamped consent and confirmation. You agree not to deviate from business to personal/ social usage, or routes/destinations with this vehicle outside of specified locations in conjunction to the rideshare app you are using for business-rental driver hours which is no more or less than (11)hours without TAKEOFF express consent or you will be fined for each occurrence up to $250.
PAYMENTS:
You consent & agree to allow TAKEOFF Inc./Stephanie White/Marcus Williams/Stripe to recieve recurring payments from your bank/rideshare or any other designated accounts by keeping an active Payment CashOut Card/Account attached for auto daily donation deductions of $125.00 and no more than $160 (7) days weekly from your rideshare/debit bank account. You agree to provide a weekly print out of days/hrs worked by you on our approved rideshare platforms or you will be automatically fined $250 daily if its removed and your vehicle/account access will be locked out. You also understand and agree that your deposit and daily rental fees are Non-Refundable, No Exceptions.
INSURANCE:
You understand and agree that there are limitations/restricted use of this rental/vehicle and if you elect to deviate from Permissive usage contract/ terms or the approved rideshare routes/destinations TAKEOFF Inc./Stephanie White/Marcus Williams will not be held liable for traffic fees/citations, accidents or insurance coverages loss personal or physical damages. Insurance Coverage will not be extended to you if you operate outside of the agreed (11) hour rental period, personal use is strongly prohibited. If and when TAKEOFF owner(s) or specified staff are present in vehicle during rental time/travel it is understood and agreed that owner has given up control, or is unable to exercise control over driver/vehicle and shall not be held liable for any damages, traffic violations or accidents civil/criminal at any time due to your negligence.
Permissive “Limited&Restricted” Usage
You understand, agree and consent to adhere to and follow these terms agreeing that your rental usage times/itinerary must align to your hours of rideshare business usage on UBER,LYFT, Doordash or other apps TAKEOFF approves only accepting all rides to maximize performance or you will be fined $250 and your account could be suspended, vehicle could be retrieved and access will be locked out without notice to you. You agree to return all Keys,Key Cards, Garage access, building fobs and Uniforms Issued to you along with the vehicle immediately to TAKEOFF Inc./Stephanie White/Marcus Williams Only or you will be fined up to $500 and could be criminally charged. You agree not to use Full-Self Driving Mode (FSD) unless on highway or you will be fined $150 deduction from your pay. You also agree to take only two (30) minute "Charge breaks" (if needed) at the closest Tesla SuperCharger for lunch & rest while charging no more than 85% never allowing battery to get any less than 20% or you will be fined $150 deduction. If battery is destroyed youll be fined/charged the cost of replacement battery. You agree to obey all laws not to text operate devices, drink, eat, smoke, sleep or use illicit substances/medications that could impair you at anytime as it is strongly prohibited and you will be fined up to $500 deduction out of your pay for each occurrence. You further agree to keep vehicles clean at all times by going through Mr. Car Wash and then go to a self service CarWash to "Vaccum, Spray down Mats & Vacuum car" every other day starting (Mon,Wed,Fri) at the closest Mr. WASH locations Or Silver Spring ONLY or you understand you will be fined with a $100 deduction for each missed occurrence. All staff/ passenger property found in vehicles must be reported to TAKEOFF staff immediately after attempting to give property to its rightful owners. TAKEOFF Inc./ Stephanie White/Marcus Williams only give explicit consent to users under Maryland State “Permissive Use” terms Only. Drivers for approved business/rideshare scheduled use of our vehicles will only have access for (12) hours, (7) days a week between 4AM-2PM and 3PM-1AM with (1) hour to travel to transfer vehicle to TAKEOFF staff/location Only. You agree to stay in the DC, MD, VA states operating within a (35-mile) travel radius in any direction using only approved rideshare apps we specify which are currently “UBER/LYFT/DOORDASH/EMPOWER/AMAZN FLEX” or driving for designated scheduled private TAKEOFF Inc. staff, clients/destinations only. You agree and are required to prioritize all TAKEOFF Staff/Affiliates Passengers Pickup/Drop-Off on TAKEOFF App first over all other apps client work or other clientele.You understand and agree that “Permission” to do certain things isn't permission to do all things as “personal use” is forbidden and strongly prohibited to help keep tickets, matainence and other vehicle wear & tear down. If found in violation of any of these terms here-in a suspension, fines, termination or even criminal actions could be taken against you.
Pick-Up/Drop-Off Locations:
You agree to Pick-Up/Drop-Off our vehicles at the nearest Metro/Marc/Lite Rail train station(s) parking-lot/garage or any other specific location we specify by the end of your 12-hour rental time unless, otherwise specified.
Traffic Tickets Citations/Valid Employment
You understand and agree that If at anytime you have a bad driver record or outstanding tickets or other infractions/background could allow us to provide you with only limited use/restrictions or none at all with termination at our sole discretion at anytime. This also applies to fluctuating/unstable or other unapproved Employment, late or missed client obligations.
Drug & Alcohol Screenings
In signing and accepting your e-signatures, You further agree that you have no current, prior criminal background, use or addiction to alcohol/drugs, mmm,or are a known habitual user of any illicit stimulants/ substances further agreeing to take random alcohol/drug test and submit any medical reports requested by TAKEOFF Inc. at any time especially if damages, accidents/infractions occur. You agree that we have no proof nor do we have imputed knowledge of risks Of mental/physical ailments or your criminal background has been revealed or made known to TAKEOFF Inc., understanding that TAKEOFF Inc or its staff/affiliates shall not be held liable for any drug, alcohol or any other civil/ criminal charges, violations, fines or fees or actions of any kind, at any time from this day forward.
MORALITY CLAUSE:
In taking possession or operating our vehicles in any way you agree to maintain our "elite" status by maintaining good conduct at all times in and outside of TAKE OFF uniform or company operations times. It is further agreed that moral terpitude is in affect and will be invoked to the fullest extent if any measure of conduct/misconduct is deemed or potentially deemed harmful to the TAKE OFF Inc., company, brand, name, its affiliates, sponsors, contractors and its employees in any way.
